   11                         'mkapachepw' LICENSE AGREEMENT

   14 1) DEFINITIONS

   16 Throughout this Agreement, the term 'mkapachepw' is used to mean:

   18 Anything included in the 'mkapachepw' software distribution package
   19 from TundraWare Inc.  This includes scripts, programs, documentation,
   20 license text and all other files provided in that original software
   21 distribution package.

   23 Throughout this Agreement the term "User" is used to mean any person
   24 who is enagaged in any of the following activities:
   25 
   26    a) Uses any files found in the 'mkapachepw' software distribution
   27       in any way.

   29    b) Reads the 'mkapachepw' documentation.

   31    c) Reads or studies the 'mkapachepw' program source code or
   32       supporting files.
   33 
   34    d) Makes use of any part of the 'mkapachepw' software distribution
   35       for any purpose.

   37    e) Duplicates and/or distributes the 'mkapachepw' software distribution.

   40 2) OWNERSHIP

   42 'mkapachepw' Is Copyright (c) 2005 TundraWare Inc. All Rights Reserved.

   45 3) TERMS

   47 Permission is hereby granted to the User for the duplication and use
   48 of 'mkapachepw' so long as ALL the following conditions are met:

   50      a) There is no license fee for PERSONAL NON-COMMERCIAL use of
   51         'mkapachepw'.  This means use by an individual for personal
   52         applications only, with no remuneration of any kind, direct or
   53         indirect, from the use of 'mkapachepw'.  Voluntary donations
   54         from such users are accepted and encouraged.  A donation of
   55         $25 US per user is recommended.  Information on how to
   56         contribute can be obtained by contacting
   57         mkapachepw@tundraware.com.

   59         Use of 'mkapachepw' in ANY OTHER SITUTATION, including
   60         for-profit organizations, non-profit organizations,
   61         educational institutions, and government organizations,
   62         requires payment of a licensing fee.  Contact
   63         mkapachepw@tundraware.com for current pricing information.

   65     b) The User of 'mkapachepw' understands and agrees that this is
   66        EXPERIMENTAL SOFTWARE which is provided "AS-IS" with no
   67        warranties expressed or implied by TundraWare Inc.

   69     c) The User acknowledges 'mkapachepw' has NOT been tested for:

   71        i)   Correct operation 
   72 
   73        ii)  Freedom from unintended consequences
   74 
   75        iii) Any operation or condition which might cause damage,
   76             compromise, or disruption to the User's or other:
   77             hardware, software, networks, or data, or which might
   78             cause any breach of system security of such systems,
   79             software, and networks.

   81      d) By using 'mkapachepw' in any way, the User does so at their
   82         own risk and agrees to hold TundraWare Inc.  harmless for any
   83         damage, direct or indirect, that this software may or does
   84         cause to the User's computational environment, including, but
   85         not limited to, the User's or others' hardware, software,
   86         network, or data.  THE USER FURTHER AGREES TO HOLD TUNDRAWARE
   87         INC. HARMLESS FOR ANY ECONOMIC DAMAGE OR ANY OTHER ADVERSE
   88         CONSEQUENCE, DIRECT OR INDIRECT, CAUSED BY THE USE OF
   89         'mkapachepw'.

   91      e) If duplicated and/or distributed, no fee beyond reasonable
   92         duplication charges may be charged for 'mkapachepw'.  No
   93         commercial use of 'mkapachepw' which involves any
   94         remuneration beyond these duplication charges is permitted.

   96      f) Any distributed copies of 'mkapachepw' must include all the
   97         originally provided software, documentation, and licensing
   98         information in their original distribution format and
   99         packaging without any modifications.

  101 By using any part or all of 'mkapachepw', you are agreeing to be
  102 bound by this license.
